Utah Nonresident Military Spouse Income
A nonresident military spouse who is not also a service member and is in Utah solely to accompany a service member under military orders may exclude qualifying spouse income from Utah tax. The couple may elect the service member’s domicile, the spouse’s domicile, or the permanent duty station for tax residency. Use TC-40A subtraction code 88 and the Tax Commission’s withholding and nonresident-return instructions.
An agency must make the actual eligibility decision.
The program is source-verified, but its eligibility rules are not automated in this record.
